Now let us imagine, however, that B’s estate presses not only for compensatory damages but for an award of punitive damages as well. It would be entirely unremarkable, indeed prosaic, for a jury to grant such an award, and no judge would dream of reversing it. Notice, however, that the propriety of such a punitive damages award cannot be grounded in the magnitude of the defendant’s mistreatment of B, for the defendant was not very negligent as toward B at all. The defendant’s vulnerability to punitive damages, in such a case, depends upon his culpability tout court, not his culpability vis-à-vis the plaintiff.163 There is no strict inconsistency in supposing that, while the defendant’s liability to compensate B depends on whether he has mistreated her, his liability to pay punitive damages to her may depend on how gravely he has mistreated others.
